Welcome to RealtorByTask. These Terms of Service (“Terms”) govern your use of our website and marketplace. By accessing or using RealtorByTask, you agree to these Terms. If you don’t agree, please don’t use the service.
1. What RealtorByTask is
RealtorByTask is a marketplace that connects homeowners with independent, licensed real estate professionals offering individual (“à-la-carte”) services. RealtorByTask is a technology platform, not a real estate broker, and not a party to the agreement between a homeowner and a realtor. The real estate services themselves are provided solely by the independent realtors.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract to use RealtorByTask. You’re responsible for the accuracy of your account information and for keeping your login credentials secure. You’re responsible for activity that happens under your account.
3. Realtor obligations
- Maintain a valid, active California DRE license and provide accurate license information.
- Describe services, pricing, and turnaround honestly, and deliver what you offer.
- Comply with all applicable real estate laws and professional obligations.
4. Homeowner obligations
Provide accurate information when booking, communicate in good faith, and pay the agreed flat fee for services you book. The scope of any service is what you and the realtor agree to on the listing.
5. Payments & fees
Services are offered at flat, upfront prices set by each realtor. Payments are processed by our third-party payment provider. RealtorByTask may charge a platform fee, which is disclosed as part of the transaction. You authorize us and our payment provider to process the applicable charges.
6. Cancellations & refunds
Cancellation and refund terms for a given service follow what the realtor and homeowner agree to and any policy presented at booking. If something goes wrong, contact us and we’ll try to help resolve it, though RealtorByTask is not responsible for the underlying services.
7. Reviews & content
You’re responsible for content you post, including reviews and listings, and it must be accurate, lawful, and respectful. You grantRealtorByTask a license to display and distribute that content as part of operating the service. We may remove content that violates these Terms.
8. Prohibited conduct
- Misrepresenting your identity, license, or services.
- Circumventing the platform to avoid fees, or using it for unlawful purposes.
- Attempting to disrupt, scrape, or compromise the service or other users.
9. Disclaimers
The service is provided “as is” without warranties of any kind. RealtorByTask does not guarantee any particular result from a real estate transaction and is not responsible for the acts, omissions, or quality of services provided by independent realtors. Verification confirms licensing at the time of review and is not an endorsement.
10. Limitation of liability
To the fullest extent permitted by law, RealtorByTask will not be liable for indirect, incidental, or consequential damages, and our total liability relating to the service is limited to the amounts you paid to RealtorByTask in the twelve months before the claim.
11. Indemnification
You agree to indemnify RealtorByTask against claims arising from your use of the service, your content, or your violation of these Terms or applicable law.
12. Governing law & changes
These Terms are governed by the laws of the State of California. We may update these Terms from time to time; we’ll revise the “last updated” date and, for material changes, provide additional notice. Continued use after changes means you accept them.
